II. SUMMARY
1. KEY EVENTS:
1.1. On 12 April 2009, M/V “HAN SPRINTER” under management of Master named Pak In Chel berthed
at Ben Nghe Port to Discharge the Urea in Bulk.
1.2. On 12 April 2009, at approximately 15:20 Hours Vietnam Standard Time (VNST), M/V “Van Xuan”
under assistant of Pilot named Nguyen Viet An maneuvered to departure from the Tan Thuan Port.
1.3. At approximately 15:55 Hours Vietnam Standard Time (VNST), Bow of STBD side of M/V “VAN
XUAN” collided to stern of SBTD side of M/V “HAN SPRINTER”.
1.4. The location of collision is in approximately 106:44’05E; 10:45’60N.
2. NARRATIVE:
On 12 April 2009, at approximately 15:20 Hours Vietnam Standard Time (VNST), the vessel “Han
Sprinter” berthed at berthing No. K.15 of Ben Nghe Port, Ho Chi Minh City – Vietnam to discharge of
Urea in bulk. Her Stbd Stern was struck by the vessel “ Van Xuan” was being navigated from Berthing
K.13 of Tan Thuan Port, Ho Chi Minh City – Vietnam
3. KEY CONDITION:
2.1. At the time of collision happen, M/V “HAN SPRINTER” had berthed safety with well equipment
onboard.
2.2. M/V “HAN SPRINTER” has obtained the certificates for seaworthiness at sea.
2.3. M/V “HAN SPRINTER” has maritime qualifications.
4. KEY RULES (IMO):
3.1. International Regulation for Preventing Collision at sea 1972 and adopted (the ColRegs).
3.2. Rule 8 of the ColRegs – Action to Avoid Collision
(a) Any action taken to avoid a collision shall, if the circumstances of the case admit, be positive,
made in ample time and with due regard to the observance of good seamanship.
(c) If there is sufficient sea room, alteration of course alone may be the most effective action to
avoid a close-quarters situation provided that it is made in good time, is substantial and does
not result in another close-quarters situation.

5. CAUSE:
4.1. Human factor of M.V VAN XUAN: Failure to comply with regulations, Failure to obtain ship position,
Misconduct/ negligence.
4.2. Environment factor– visibility was in sight of one another at daylight.
4.3. In navigation, M.V :”VAN XUAN” had failure to keep a proper distance as near to the M.V “Han
Sprinter” berthed at the Ben Nghe Port.
III. CAUSE OF DAMAGES & LOSS
1. CAUSE OF DAMAGE:
1.1 Identification:
On 12 April 2009, at approximately 15:20 Hours Vietnam Standard Time (VNST), the vessel “Han
Sprinter” berthed and discharged at Ben Nghe Port, Ho Chi Minh City – Vietnam. Her STBD Stern was
struck by the vessel “ Van Xuan” was being navigated.
1.2 Navigation Rules (International Regulation for Preventing Collision at sea):
Rule 8 (a) & (c) of the ColRegs – Action to Avoid Collision:
(a) Any action taken to avoid a collision shall, if the circumstances of the case admit, be positive,
made in ample time and with due regard to the observance of good seamanship.
(c) If there is sufficient sea room, alteration of course alone may be the most effective action to
avoid a close-quarters situation provided that it is made in good time, is substantial and does
not result in another close-quarters situation.
Root cause:
The cause of this incident was M.V VAN XUAN had failure to comply with the requirements of the
Collision Regulations. The M.V Van Xuan did not comply with the requirements of Rule 8 of International
Regulation for Preventing Collision – Action to Avoid Collision.

Hull plating & Frames were damaged, deformed (#19-21) with size (5.1mL x 2.4mH) on the E/R.
Hull plating & Frames were damaged & deformed, dented & torn (#22-29) under loadline position on
the E/R.
Hull plating & Frames damaged & deformed broken (#32-34) with size (2.0mL x 1.5mH) under
loadline position on Bunker tank.
The horizontal stringer plating was dented & deformed at (#32-34) with size (2.0mL x 1.5mW) on
F.O Bunker tank.
Bulkhead of E/R was dented & deformed (#27-28).
Ladder of gangway was damaged & deformed

Hull plating of astern was holed, torn, deformed (#01-18) with size (12.5mL x 4.8mH x 0.11T) on the
P/R & E/R.
Web frames of astern were torn, deformed, cracked (#01, 06 & 10) with size (200mm x 700mm) on
the P/R & E/R.
Weak frames of astern were torn, deformed, cracked (#02, 03, 04 & 05, 07, 08, 09, 11, 12, 13) with
size (200mm x 90mm) on the P/R & E/R.
Bulkhead of P/R-E/R was torn & deformed.
02 hydraulic pipes of pumping machine were broken with size Ø34mmx8mL.

Basing on the results of joint survey at the site, referring to the Invoice No. DVSR-0905/01/HSP of Dongil
Vungtau Shipyard & Engineering Co., Ltd., and loss of ship-owner, we would like to expose costs of
damages & loss as followings.

VI. CONCLUSION
Basing on the official results of our inspection, and refer to the relative document, witness, we are of the
opinion that the damages and loss to M.V Han Sprinter due to the following causes:
• The M.V “Van Xuan” collided to M.V “Han Sprinter” while M.V “Han Sprinter” berthed and discharged
at Ben Nghe Port, Ho Chi Minh City – Vietnam.
Basing on the inspection results, we - AIM Control are of the opinion that the seriously damages to the
M/V HAN SPRINTER were consequence from the impact of collision and suggest that the parties
concerned should have reasonable procedures for satisfactory compensation regarding repair and/or
renewal the loss / damages to M/V HAN SPRINTER and costs incurred in connection with claims to
comply with all the requirements of the technical safety for re-operation.
